This agreement is made between Jacqueline Collen-Tarrolly, owner, and Toadstool Farm, hereafter referred to as Breeder, and _______________________________ , hereafter known as the Mare Owner, on the following date: ___________________ and is subject to the following conditions.

Stallion Service Fee -- The fee is dependent upon the stallion chosen. Any booking made prior to December 31st, 2005, receive a $50 discount from the stated stud fee for any stallion. The 2004 breeding season is defined in this contract as January 1st, 2006 to August 31st.
The fee for above named stallion is $________________ which the mare owner agrees to pay as follows:
- $200 non-refundable booking fee to hold the service due at signing of this contract. This fee will be applied towards the total stud fee.
- Balance of stud fee to be paid prior to shipping of semen.
Shipping and Collection Costs -- Mare owner is responsible for any and all collection, and shipping charges. All collection and shipping charghes will be billed or charged directly by Breeder's reproduction veterinarian; Humphrey, Giacopuzzi Veterinary Clinic. All arrangements for this must be handled prior to any shipping of semen. No shipments will be made until all applicable fees and deposits are received by the Breeder and /or the above named Veterinarian. An invoice showing all payments and deposits will be mailed to the Mare Owner at appropriate intervals. Please contact the above named Veterinarian within a reasonable amount of time prior to expected collection and shipping in order to arrange payment for your shipping and collection. (805) 386-4291
Mare Owner's Responsibility -- Mare Owner agrees to the following. The mare will be checked by a veterinarian to be determined in sound and healthy breeding condition. Shipped semen to be used on named mare only. Semen will be shipped based on said veterinarians estimated time of ovulation to be determined by ultrasound. Mare Owner further agrees to make Breeder aware of Mare's cycles so that scheduling of collection can be done with a reasonable amount of foreknowledge. No semen collections will occur without at least a 48 hour notice. This policy is FIRM, due to all collections being handled off site and the need for prior appointments.
Mare owner will ensure that mare is properly cared for and will receive all necessary wormings and vaccinations as determined by a veterinarian in Mare's State of residence. Mare Owner agrees that failure to comply with this Responsibility will void the Live Foal Guarantee. Should mare die prior to conception and a veterinarian's certificate of death is supplied to Breeder, all breeding fees, minus shipping and collection fees already incurred, will be refunded.
Mare owner further agrees to confirm pregnancy through an ultrasound given by a veterinarian and to provide confirmation of pregnancy to Breeder by no later than 60 days after insemination.
Collection Schedule-- Collections can be made Monday through Friday. If a collection needs, or is tentatively thought to be needed, to be made on a Monday, notice must be given to Breeder no later than Friday afternoon before 4:00 p.m., Pacific Standard Time, so that a collection appointment can be made with our vet. This policy is FIRM as the Breeder is not the only one whose schedule must be arranged. The Breeder does not have a start and end date for the breeding season, so we are able to accomadate your needs.
Live Foal Guarantee -- The Breeder guarantees a live foal from this breeding. Live Foal to be defined as one that stands and nurses. If the mare does not conceive, the pregnancy fails or the foal is still born a re-breeding for the following season only will be honored as long as the Breeders are notified within seven (7) days of death of foal or discovery of failed pregnancy, and a veterinarians certificate of death is received. A re-breeding will not be honored if the mare owner fails to have the mare confirmed pregnant and not carrying twins through an ultrasound. A substitute mare for this breeding may be accepted only if approved prior to rebreeding by Breeder. All shipping and collection fees will be owed by the Mare Owner for any rebreeding.
Stallion Breeding Fitness -- Should the stallion named in this contract die or become unable to perform this stallion service and the mare named has not yet conceived, and the mare owner has met all obligations within this contract, the Mare Owner will have the option of:
- Transferring stud fee to another of Toadstool Farms standing stallions
- Receiving a refund of all fees minus any shipping and collection fees already incurred.
Breeding Certificate -- A Breeding Certificate will be issued in January of the foaling year to all clients who have met all terms of this agreement and who have provided proof of pregnancy to be determined by a veterinarians ultrasound.
Non-Assigns -- This agreement is non-assignable and non-transferable.
Right of Refusal -- Toadstool Farm reserves the right to refuse service to any mare or mare owner or void this contract without notice and without recourse to mare owner should it become known that mare has failed to produce a live foal for two consecutive years, becomes ill or injured in a way that would prevent a pregnancy or prove harmful to either herself or a foal should a pregnancy occur, or is improperly cared for, or in any other way proven to be known as unfit for breeding. If such a cancellation becomes necessary, Breeder will return stud fee, less booking fee and shipping/collection expenses already incurred.

- Due prior to first shipment:
- Balance of stated stud fee (minus $50 discount if contract received prior to January 1st, of the year before that in which breeding is to occur.)
- Payment arrangements made with our collection vet as outlined.
- Adequate notice of mare's heat cycles.
